This Privacy Policy describes how StaxRx collects, uses, discloses, and protects personal information in connection with the StaxRx websites, merchant portal, applications, technology, and related services (collectively, the “Services”).

This Privacy Policy applies to Merchants, their authorized users, and other individuals who interact with StaxRx in connection with the Services.

This Privacy Policy does not describe the privacy practices of independent healthcare providers, pharmacies, Merchants with respect to their own independent activities, or other third parties. Those entities may maintain separate privacy policies and practices that apply to information they collect or process independently.

2. Information We Collect

Depending on how you interact with the Services, StaxRx may collect the following categories of personal information:

Account and Contact Information

  • Email address
  • Phone number
  • Account credentials and login information

Business Information

  • Business name and entity information
  • Business contact information
  • Business address
  • Licenses, registrations, and other business verification information
  • Information provided during Merchant onboarding or account setup

  • Information necessary to process payments, refunds, or chargebacks

Payment card information may be collected and processed by StaxRx’s payment processing providers rather than stored directly by StaxRx.

Usage and Technical Information

  • Login activity
  • Platform activity and usage information
  • Cookies and similar technologies
  • Security and diagnostic information

Communications and Support Information

We may collect information you provide when you communicate with StaxRx, contact customer support, submit requests, or otherwise interact with our team.

StaxRx may collect personal information from the following sources:

Information You Provide Directly

We collect information you provide when you apply to become a Merchant, create or manage an account, configure your storefront, submit business or payment information, communicate with StaxRx, or otherwise use the Services.

Information Collected Automatically

When you access or use the Services, we may automatically collect certain technical and usage information through cookies, log files, and similar technologies.

Information From Third Parties

We may receive information from third parties that support the Services, including payment processors, identity or business verification providers, technology providers, and other service providers.

Information Generated Through Your Use of the Services

We may generate or collect information relating to your account activity, transactions, platform usage, support interactions, and other activities conducted through the Services.

4. How We Use Information

StaxRx may use personal information to:

  • provide, operate, maintain, and improve the Services;
  • create and manage Merchant accounts and storefronts;
  • process payments, payouts, refunds, chargebacks, and related transactions;
  • verify Merchant identity, business information, and eligibility;
  • communicate with Merchants regarding their accounts, transactions, Services, support requests, and important updates;
  • provide customer service and technical support;
  • monitor platform performance and improve functionality and user experience;
  • detect, investigate, and prevent fraud, security incidents, misuse, or other unauthorized activity;
  • enforce our agreements, policies, and terms;
  • comply with applicable legal, regulatory, tax, and compliance obligations; and
  • establish, exercise, or defend legal claims and protect the rights, safety, and property of StaxRx, our users, and others.

We may also use information for other purposes disclosed at the time of collection or with your consent where required by applicable law.

5. How We Share Information

StaxRx may disclose personal information as necessary to operate the Services and conduct our business, including to:

  • service providers that support payment processing, hosting, communications, analytics, security, customer support, and other business operations;
  • professional advisors, including attorneys, accountants, auditors, and consultants;
  • government agencies, regulators, law enforcement, or other parties when required by law or reasonably necessary to comply with legal obligations;
  • parties involved in investigating or preventing fraud, security threats, unlawful activity, or violations of our agreements or policies; and
  • parties involved in a merger, acquisition, financing, reorganization, sale of assets, or other business transaction involving StaxRx.

We may also disclose information at your direction, with your consent, or as otherwise disclosed at the time information is collected.

StaxRx does not sell Merchant personal information for monetary consideration. Where applicable law defines “sale,” “sharing,” or similar terms more broadly, StaxRx will provide any disclosures and choices required by applicable law.

6. Service Providers and Third Parties

StaxRx works with third-party service providers that perform services on our behalf or support the operation of the Services. These providers may include companies that provide:

  • payment processing and financial services;
  • cloud hosting and data storage;
  • communications and messaging services;
  • analytics and platform performance tools;
  • identity and business verification;
  • security and fraud prevention;
  • customer support; and
  • other technology and operational services.

These service providers may access or process personal information only as reasonably necessary to perform services for StaxRx or as otherwise permitted by applicable law.

Third-party websites, platforms, or services may maintain their own privacy practices. StaxRx is not responsible for the privacy practices of third parties when they collect or process information independently of StaxRx.

StaxRx may use cookies and similar technologies to operate and improve the Services, maintain user sessions, remember preferences, understand how the Services are used, and support security and fraud prevention.

These technologies may collect information such as device identifiers, browser type, IP address, pages viewed, interactions with the Services, and other usage information.

Some cookies and similar technologies may be provided by third-party service providers that support analytics, security, communications, or other platform functionality.

Where required by applicable law, StaxRx will provide appropriate choices regarding the use of non-essential cookies and tracking technologies.

You may also manage certain cookie preferences through your browser settings, although disabling certain cookies may affect the functionality of the Services.

8. Data Retention

StaxRx retains personal information for as long as reasonably necessary to provide the Services, maintain the Merchant relationship, and fulfill the purposes described in this Privacy Policy.

We may retain certain information after a Merchant account is closed or the business relationship ends when necessary to comply with legal, regulatory, tax, accounting, or contractual obligations; resolve disputes; prevent fraud or abuse; enforce our agreements; or establish, exercise, or defend legal claims.

When personal information is no longer reasonably necessary for these purposes, we will delete, anonymize, or otherwise dispose of it in accordance with applicable law and our data retention practices.

9. Data Security

StaxRx maintains reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, or destruction.

These safeguards may include access controls, authentication measures, encryption, monitoring, and other security practices appropriate to the nature of the information and the Services.

While StaxRx takes reasonable measures to protect personal information, no system, network, or method of electronic transmission or storage can be guaranteed to be completely secure.

Merchants are responsible for maintaining the security of their account credentials and promptly notifying StaxRx of any suspected unauthorized access or security incident involving their account.

10. Your Privacy Rights and Choices

Depending on where you reside and applicable law, you may have certain rights regarding your personal information, including the right to:

  • request access to personal information we maintain about you;
  • request correction of inaccurate personal information;
  • request deletion of certain personal information;
  • request information about how we collect, use, or disclose your personal information;
  • obtain a copy of certain personal information;
  • opt out of or limit certain types of data processing where required by law; and
  • appeal a decision regarding a privacy request where provided by applicable law.

You may also manage certain account information and communication preferences through the Services or by contacting StaxRx.

To protect your information, StaxRx may take reasonable steps to verify your identity before processing a privacy request. Certain requests may be limited or denied where permitted by applicable law.

Where permitted by law, an authorized agent may submit a request on your behalf. StaxRx may require verification of your identity, residency, or the agent’s authority before processing a request.

StaxRx will process applicable privacy requests in accordance with the requirements and timelines established by law and will not discriminate against individuals for exercising their privacy rights.

11. Business Transfers

StaxRx may disclose or transfer personal information in connection with an actual or proposed merger, acquisition, financing, reorganization, sale of assets, change of control, bankruptcy, or similar business transaction.

12. Children’s Privacy

The Services are not intended for individuals under 18 years of age. StaxRx does not knowingly collect personal information from individuals under 18 through the Merchant Services.

If StaxRx becomes aware that personal information has been collected from an individual under 18 in connection with the Merchant Services, we will take reasonable steps to delete the information as required by applicable law.

13. Changes to This Privacy Policy

StaxRx may update this Privacy Policy from time to time to reflect changes in our Services, business practices, technology, or applicable legal and regulatory requirements.

When we make changes, we will update the effective date of this Privacy Policy and provide any additional notice required by applicable law.

We encourage Merchants to review this Privacy Policy periodically to stay informed about our privacy practices.
